Probably because they're doing so badly, which is hardly surprising given the quality of their phones these days.

I wonder, Sebby, if it was to allow apple build up a big userbase and then hit apple with a massive charge rather than charge from the outset and have find alternative ways to mitigate the charge?

As for the quality of their phones, I've never had a issue with any at all and thought the n95 was a great phone. Unfortunately for them, because it was such a good phone, it became a hard act to follow which is why the n96 was a bit of a flop.

TBH I would have thought they should sue the supplier of the baseband chip, in this case BroadCom.  AFAIK, the telephone side of the iPhone is built from stock parts.

Didn't they do a deal with BroadCom a while back?  If so, this looks like trying to have a second bite out of the er, Apple.   :)
