client side upgrades are not going to work because of the pain of trying to get everyone to update all thier software at once. The article author suggests draconian penalties for cheats to force them to upgrade but I don't think that is a sensible option either.

IMO if you need to traffic shape you are overselling and need to stop advertising packages you can't afford to provide.

also IMO traffic shaping can be protocol neutral, just give lower priority users who are detected as using an unfairly large share.

I completely agree. IDNet are proof that it isn't needed if the product is right in the first place.
